If you are an unmarried heterosexual or same-sex couple who is ending a relationship in North Carolina, the state’s equitable distribution laws do not apply to you.
There are contractual ways to provide unmarried couples with the same property rights that married couples have, but these contracts are typically put in place before the parties decide to end the relationship. When addressing division of property where no contract exists, the law will divide assets based upon whose name is on the title of ownership or the party who can prove he or she paid for the property, with limited exceptions.
